Unless otherwise indicated, the The Ark website and its contents (including without limitation, all thest, photographs, images, video and audio) are the exclusive property of The Ark Pty Ltd, trading as The Ark (hereinafter referred to as "The Ark") and are protected by copyright, trademark, trade dress and other laws.

The Ark is an Australian fashion business. All items, products and services displayed are in AUD Australian dollars unless otherwise stated.

Terms of Sale

All orders are subject to the following terms and conditions:

1. All orders are subject to availability and confirmation of the order price
2. Unforeseen problems or unexpected demand may occasionally result in stock being unavailable
3. In this case we will provide a full refund
4. Dispatch times may vary according to availability and any guarantees or representations made as to delivery times are subject to any delays resulting from postal delays for which we will not be responsible. Please see our delivery and returns policies for further information.

Sales and Promotions

The Ark Clothing Co. reserves the right to cancel any sale or promotion at any time.

Online Warehouse Sale 2024

1. Items reduced in our Warehouse Sale are not eligible for return or exchange. Full priced items purchased during the sale can be returned per our policy.
2. Items added to your cart during the sale period are not held for you. Items are only secured once payment has been processed & checkout is complete.
3. VIPs are welcome to use their discount code on reduced items.
4. In the unlikely event there is a stock discrepancy or technical fault, our Customer Care team will be in touch ASAP to provide you with a refund or replacement item.
5. While we do everything we can to ensure items are thoroughly checked for quality, sometimes a fault can be missed, or your order can be damaged in transit. If you suspect an item you've received is faulty, please contact our Customer Care team per our policy.
   Please note, the fabric tags on some styles included in the Warehouse Sale Frenzy have a small notch cut in the centre - this does not affect the wearability or function of the piece and as such does not qualify as a fault.
6. We're working hard to get your orders posted ASAP! Due to the volume of orders during this period, please allow 5 business days for your order to be dispatched. You will receive a link to track your parcel via email once it's on its way.

2. Offer is not valid with any other discount.
3. Offer is only valid on our Basics. pieces and can be used on any number of pieces if they are purchased in multiples of 3.
4. Discount will be automatically applied ot the lowest priced piece when you add 3 Basics. pieces into your cart.
5. In the event the free piece is returned, no refund will be issued. If you return one of the full priced pieces, you will be refunded the RRP of that piece less the RRP of the free piece at time of purchase.

General Discounts

1. The Ark Clothing Co. cannot guarantee the availability of stock during any sale period.
2. Discounts cannot be retrospectively applied to previous orders.
3. Applicable refunds or credit notes provided will only reflect the purchase price of the item as displayed on the receipt, rather than the original ticket price.
4. We may offer promotional discount codes to be used on all or part of the site.
5. Discount codes may not be used to purchase gift cards.
6. Free Shipping promotions apply to domestic AU addresses only, and exclude Express Post unless otherwise stated.
